Gregory E. Tomczak is a litigation and trial attorney concentrating his practice in the areas of probate and estate litigation, complex commercial litigation, and white-collar criminal defense. He has extensive trial experience, having served as lead counsel in over 25 jury trials, 40 non-jury trials, countless evidentiary hearings, and numerous appeals. Greg’s civil litigation experience at the state and federal level includes representation of individuals in all types of probate and estate litigation matters, including, but not limited to, will contests, claims of undue influence, breach of fiduciary duty, and claims of theft of estate assets. Most notably, he represented the Plaintiff in a $4.5 Million estate litigation wherein his client sued his brother and only coheir to the estate for refusing to submit to a valuation of the estate assets which included a closely held family business in addition to numerous other precious metals and diamonds. The Court ordered a full appraisal and accounting and his client received his fair share of the estate.
Greg has represented individuals and business organizations, both domestic and international, in complex commercial litigation involving partnership disputes, contract disputes, employment disputes concerning unfair business competition and restrictive covenants, business torts, construction disputes, real estate transactions, public contract procurement, accounting liability, securities fraud, and breach of fiduciary duty. His broad range of substantive experience also allows for an integrated approach to the full range of a client’s problems because criminal and government enforcement activity rarely appear in isolation; they are often accompanied by parallel civil proceedings. He had both won and successfully defended countless multi-million-dollar cases and other bet-the-company litigation. His former clients include former State Governors, the former General Partner of the NY Yankees, a multi-national hotel conglomerate, and many other multi-million-dollar businesses.
Greg’s regulatory experience includes representation of individuals and business organizations in connection with state and federal investigations and prosecutions, responding to grand jury subpoenas and inquiries from governmental and/or regulatory agencies, and administrative enforcement/debarment proceedings. He also has experience conducting corporate internal investigations into suspected wrongdoing and evaluating potential exposure to criminal or civil liability. He has counseled businesses, their boards of directors, and board committees on issues relating to voluntary disclosures to governmental agencies and maximizing the benefits of cooperation with such agencies.
Since 2009, Greg has been recognized in New Jersey Monthly magazine by Super Lawyers as a New Jersey Rising Star (2009-2014) and a Superlawyer (2015 to 2019) in the areas of business litigation and white-collar criminal defense, an honor reserved for less than 5% of attorneys. In 2012, he was recognized as a “New Leader of the Bar” by the New Jersey Law Journal, ranking him as one of the Top 50 Attorneys in New Jersey under the Age of 40. Most recently, in 2020, he was recognized by American Registry as one of “America’s Most Honored Lawyers.”
In 2009, Greg was certified by the New Jersey Supreme Court as a Criminal Trial Attorney, a distinction held by less than 250 out of 98,000 attorneys in the State.
Greg earned his Juris Doctor degree from The George Washington University Law School in 2002, and earned a B.A. in Philosophy, magna cum laude, from Rutgers University in 1999. He is licensed to practice law in the states of Arizona, New Jersey, and New York.
